1. Scope of Application

The following General Terms and Conditions (GTC) apply to all orders placed via our online store. Our online store is exclusively aimed at consumers. A consumer is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business or profession. An entrepreneur is a natural or legal person or a partnership with legal personality who or which, when entering into a legal transaction, acts in exercise of their trade, business or profession. By placing an order, you warrant that the purchased items are intended solely for your personal or domestic use and not for commercial resale or export.

2. Contracting Parties, Conclusion of Contract, Correction Options

The purchase contract is concluded with Kima Style, owner Kimia Nazemzadehnaraghi. The presentation of the products in the online store does not constitute a legally binding offer, but rather an invitation to place an order. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained for this purpose in the order process. By clicking the order button, you submit a binding offer to purchase. When selecting payment methods with immediate payment processing (e.g., PayPal, Credit Card, Apple Pay, Google Pay, Shop Pay), the purchase contract is concluded at the moment you confirm and instruct the payment in the order process.

3. Relationship to Shopify (Platform Operator)

Our online store is operated via the e-commerce platform Shopify, which enables us to offer our products to you. However, all purchase contracts in our store are concluded exclusively and directly between you and Kima Style. Shopify is not legally involved in the contractual relationship between you and us and assumes no responsibility or liability for aspects of the sale, including any defects, damages, or losses resulting from the products purchased from us. All claims and questions regarding your orders must be directed exclusively to Kima Style.

4. Contract Language, Storage of Contract Text

The language(s) available for the conclusion of the contract: German, English. We save the text of the contract and send you the order data and our GTC in text form. You can view the contract text in our customer login area.

5. Product Presentation and Color Variations

We strive to display the colors and details of our products in our online store as realistically as possible. Please note that due to different screen settings and end devices, there may be slight color variations between the photos in the online store and the delivered original product. Since we work with natural materials such as leather, slight variations in structure and grain are typical for the material. Such minor, technically or naturally caused deviations from the product presentation do not constitute a material defect, provided the goods conform to the agreed quality.

6. Item Availability and Production

(1) Product Offering

Kima Style offers both pre-made and in-stock products as well as products that are individually crafted for you in our studio upon receipt of your order.

(2) In-Stock Products (Ready-to-Ship)

Products marked as in-stock or immediately available are already completed and will be shipped after order processing. The statutory right of withdrawal applies to these regular stock items.

(3) Individualized and Custom-Configured Products

The statutory right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for the manufacture of which an individual choice or decision by the consumer is decisive or which are clearly tailored to personal needs (custom-made/bespoke). This explicitly also applies to our base models if you have specified individual requirements for their production (such as the specific selection of leather type, color, or hardware). For regular models that are merely made to order without individual material or color selection by the customer, however, the statutory right of withdrawal remains in effect. The complete terms and conditions regarding the right of withdrawal as well as the model withdrawal form can be found on our separate cancellation policy page.

Procedure for Bespoke Orders:

For fully individualized creations (Bespoke), we first agree on the fundamental details such as model, leather type, and hardware with you and create an individual offer based on this. Upon acceptance of this offer, the agreed down payment (advance payment) becomes due. Once this advance payment has been received by us, we develop the final sketch and the detailed design for your product. We then submit this final design to you for your explicit approval. The actual production and the calculation of the production time only begin after you have given us your final consent (production approval) for this design.

(4) Properties of Natural Materials

Natural materials such as leather may exhibit natural differences in terms of color, grain, structure, and surface. Such material-typical variations do not in themselves constitute a defect, provided the agreed quality and statutory requirements are met.

7. Prices and Shipping Costs

All prices stated in our online store are total prices exclusive of applicable shipping costs. In accordance with Section 19 of the German Value Added Tax Act (UStG - small business regulation), no value-added tax (VAT) is shown. The exact shipping costs will be clearly communicated to you during the order process.

9. Delivery Conditions and Shipping Costs

(1) Shipping and Return Costs:

The customer bears the applicable shipping costs for the delivery. The exact amount of the shipping costs depends on the shipping method you select during the order process and is transparently displayed there. In the event of a withdrawal (valid for non-individualized items), the customer bears the direct costs of returning the goods.

(2) Method of Delivery:

We only deliver by dispatch. Unfortunately, self-collection of the goods from our studio in Berlin is not possible.

(3) Processing and Delivery Times for In-Stock Items (Ready-to-Ship):

The processing and packaging of in-stock items takes place within 1 to 2 business days after acceptance of your order. The total delivery time results from our processing time plus the transit time of the selected shipping provider shown in the order process.

(4) Custom-Made Items (Made-to-Order & Bespoke):

For individually crafted or Bespoke products, the production and delivery time may vary depending on the scope of the customization. The estimated production or delivery time will be individually agreed upon in advance. We will first inform you via email about the final completion of your product. The subsequent dispatch also takes place within 1 to 2 business days after this completion notification.

 (5) Shipping Confirmation and Delivery Delays:

As soon as your package leaves our studio and has been handed over to the shipping service provider, you will receive a shipping confirmation from us containing a tracking link. Should there exceptionally be a significant delay during transit, we will inform you as early as possible. The statutory rights of the customer (especially in the event of default of delivery) remain unaffected.

10. Retention of Title

The delivered goods remain the property of Kima Style until the purchase price has been paid in full.

11. Contents and Materials Provided by the Customer

If you transmit your own content (e.g., your own sketches, images, logos, or texts) to us for the individual production of a product, you warrant that you are authorized to use them and that no rights of third parties (in particular copyright or trademark rights) are infringed thereby. We reserve the right to refuse the production of orders and to withdraw from the contract if the transmitted contents violate applicable law or common decency or obviously infringe the rights of third parties.

12. Copyrights and Rights of Use for Sketches and Designs

We reserve all property rights and copyrights to all designs, sketches, drafts, patterns, and preliminary products created by Kima Style. Even if sketches or designs are specially developed within the scope of an individual customer order (Bespoke), all intellectual property rights remain fully with Kima Style. The transmission of sketches, drafts, or patterns to the customer occurs exclusively for the purpose of coordination and production approval. Passing these documents on to third parties, their reproduction, imitation, or any other commercial use is strictly prohibited without our express, prior consent in text form. We expressly reserve the right to use the designs, sketches, patterns, and ideas developed within the scope of individual customer orders without restriction for our own purposes. This includes the right to manufacture further products based on these designs, add them to our regular assortment, and sell them to other customers.

13. Warranty and Guarantees Statutory Warranty Rights:

The statutory warranty rights for defects apply. In the case of handmade products as well as natural materials, minor variations typical of the material or craftsmanship may occur. Such variations typical of the material do not constitute a defect. The statutory requirements regarding the agreed and objectively expected quality of the goods remain unaffected.

Guarantees and Customer Service: Information on any additional guarantees that may apply (e.g., voluntary durability guarantees) and their exact conditions can be found with the respective product and on special information pages in the online store.

14. Liability

We are fully liable for intent and gross negligence as well as in accordance with the provisions of the German Product Liability Act (Produkthaftungsgesetz). In cases of slight negligence, we are generally only liable for injuries to life, body, and health of persons.

If this does not apply in a case of slight negligence, we are only liable in the event of a breach of material contractual obligations. These are obligations the fulfillment of which is essential for the proper execution of the contract and on the observance of which the contractual partner regularly relies. Liability for the breach of a material contractual obligation is limited to the foreseeable damage typical for the contract, which we had to expect at the time of the conclusion of the contract based on the circumstances known at that time. The limitation of liability contained herein also applies in favor of our vicarious agents.

15. Dispute Resolution

We are neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.

16. Applicable Law

The law of the Federal Republic of Germany applies to all legal relationships between the parties. For consumers, this choice of law applies only to the extent that the granted protection is not withdrawn by mandatory provisions of the law of the state in which the consumer has their habitual residence.
